Terms and Conditions of Use

Preamble

These General Terms and Conditions of Use (GTCU) govern access to and use of the Lotoasso website (hereinafter "the Site") and services offered by Lotoasso (hereinafter "the Services").

These GTCU apply automatically to any use of the platform, from the moment of accessing the Site or using the Services.

Access to and use of the Site implies full and complete acceptance of these GTCU.

Definitions

User: any natural or legal person accessing the Site or using the Services.

Services: all features offered by Lotoasso via the Site and its mobile applications.

Account: personal space created by the User to access the Services.

Acceptance of GTCU

These GTCU apply automatically from the moment of accessing the Site or using the Services, without requiring additional explicit acceptance.

Use of the Site and Services implies unreserved acceptance of these GTCU.

If you do not accept these conditions, you must not use the Site or Services.

Eligible Users

Lotoasso Services are intended exclusively for associations registered under the French Act of July 1, 1901, and for service provider companies acting on behalf of these associations in the context of organizing non-profit bingo events.

Service provider companies are authorized to use the Services only within the framework of a mission entrusted by an association, provided that the association retains the status of official organizer of the bingo in accordance with current regulations, particularly regarding declaration obligations to the prefecture.

The association remains responsible for the event and must complete all administrative declarations and formalities required for organizing non-profit bingo events.

Any use of the Services for purposes other than those mentioned above or by entities other than those listed is strictly prohibited.

User Account

To access certain Services, you must create an account by providing accurate and up-to-date information.

You are responsible for the confidentiality of your login credentials.

You agree not to share your credentials with third parties.

Lotoasso reserves the right to suspend or delete any account in case of non-compliance with these GTCU.

Use of Services

You agree to use the Services in accordance with their intended purpose and in compliance with applicable legislation.

It is strictly forbidden to use the Services for illegal, fraudulent or harmful purposes.

You agree not to disrupt the operation of the Site or Services.

Scraping, automated data extraction, web scraping or any other automated method of collecting content from the Site is strictly prohibited without prior written authorization from Lotoasso.

Obligations regarding Stripe payments

For associations using online payment services via Stripe, you agree to provide Stripe, within the required timeframes, all information necessary to enable the collection of payments in good and due form.

This information includes in particular: the complete address of the association, the contact details of the president (name, first name, address, phone, email), the contact details of the treasurer (name, first name, address, phone, email), tax information (SIRET number, RNA number if applicable), as well as any other information requested by Stripe as part of the verification of your account.

Failure to provide this information or providing incomplete or erroneous information may result in the suspension or termination of your access to payment services, without notice or refund.

Lotoasso cannot be held responsible for consequences resulting from non-compliance with these obligations.

Intellectual Property

The Site and all its elements (texts, images, logos, etc.) are protected by intellectual property law.

Any reproduction, representation, modification or adaptation without authorization is prohibited.

Trademarks and logos on the Site are the property of their respective owners.

Liability

Lotoasso strives to ensure the availability and proper functioning of the Site and Services, without absolute guarantee.

Lotoasso cannot be held responsible for direct or indirect damages resulting from the use or inability to use the Site or Services.

Lotoasso does not guarantee the accuracy, completeness or timeliness of information published on the Site.

Organizer's Responsibility

Lotoasso is a digital tool to assist in organizing non-profit bingo events. The use of the Services in no way releases the association or organizer from its legal and regulatory obligations.

The association or organizer remains solely and fully responsible for organizing their event, particularly with regard to:

- Compliance with regulations applicable to non-profit bingo events (prefecture declarations, authorizations, etc.)

- Compliance of the event with applicable laws

- Tax, accounting and administrative obligations

- Participant safety and civil liability

- Management of payments, prizes and winnings

Lotoasso disclaims all responsibility in case of non-compliance with regulations by the association or organizer. The association undertakes to verify and comply with all legal obligations applicable to organizing non-profit bingo events.

In case of failure to meet regulatory obligations, the association or organizer will alone assume the legal, administrative and financial consequences that may result.

Lotoasso reserves the right to suspend or terminate access to the Services for any association or organizer whose use would be contrary to applicable legislation.

Modifications

Lotoasso reserves the right to modify these GTCU at any time.

Modifications take effect upon publication on the Site.

It is recommended to regularly consult the GTCU to be aware of any modifications.

Termination

You may stop using the Site and Services at any time.

Lotoasso reserves the right to suspend or terminate your access to the Services in case of non-compliance with these GTCU, without notice or refund.

Disputes

These GTCU are subject to French law.

In case of dispute, and after attempting amicable resolution, the competent courts will be those of the Lotoasso registered office.
